Car accidents can leave victims severely injured, faced with damaged property, or both. What if your a Passenger?

Passengers in a car accident most likely have a valid insurance claim. This is because as a passenger you are not in control of the vehicle. Therefore, you are not in control of what the person driving the vehicle you are riding in is doing nor are you in control of what other vehicles are doing. We have settled numerous cases for clients that were passengers in a car accident. If you have been an injured passenger in an auto accident, you should call me for a free consultation (434) 660-9701.

Applicable Insurance Policies

When a car accident occurs there are usually several implications depending on what state you are in as to which insurance coverage may apply. In some states there is what is known as “PIP” coverage or Personal Injury Protection. This is where your own insurance pays your medical bills and lost wages regardless of who was at-fault. These are typically called “no-fault” states. However, in Virginia, in order for your auto insurance company to pay for your medical bills even if you caused the accident you will likely need what is known as "Med-Pay." Med-Pay is an additional coverage that insured people can purchase as part of their auto insurance coverage.

Secondly, after a car accident it is usually designated who was “at-fault.” This persons insurance coverage is commonly referred to as the “BI” or bodily injury coverage. This is insurance that covers the negligence of the person that caused the wreck. This is where we look to first to obtain personal injury compensation for our clients claims. Bodily Injury Insurance coverage however, does not always cover everything. For example, if the at-fault party purchased the lowest coverage available in Virginia, which is $30,000.00 per person. In other words, legally drivers are required to be insured up to $30,000.00 for bodily injury they may cause another person. Or, pay the DMV uninsured motorist fee of $500.00. If one of those two is not in effect, a driver is breaking the law by operating on Virginia roads.

Finally, sometimes after a car accident our clients will have what is known as “UM” or uninsured/underinsured motorist coverage. This is insurance coverage that you can choose to have above and beyond regular insurance coverage. This is good coverage to have given that accidents can quickly cost way more then the Virginia minimum coverage limits of $30,000.00 In the event the person that caused the accident does not have coverage or does not have enough insurance coverage, like a small policy limit, then the UM policy will kick in. I have recovered compensation for clients for UM claims.

Frequently Asked Questions:

How much time do I have to pursue my rights to compensation?

What are the statute of limitations for a Car Accident? In Virginia a party has two years from the date of loss to pursue their rights to compensation. Essentially, you will need to either settle the case or, file a lawsuit within two years to protect your rights. Unfortunately, I have had potential clients come to me after the two year period with injuries from an accident they never asserted their rigths too and it was to late for me to help them. Do not wait that long though. Because, it often takes time for an attorney to prepare a case for a proper insurance claim or if the insurance company doesn't properly value the case, litigation. Some attorneys will not even take a case if it is too close to the statute of limitations. I review each case on a case by case basis soo fee free to call me where ever you timeline may be.

Should I get a lawyer for a minor car accident?

Yes, it is important to contact a lawyer for any kind of car accident and take advantage of a free consultation. Depending on the situation of how the crash happened, any possible injuries, and the damage to the vehicles, a car accident lawyer might be in your best interest.

When should you contact a lawyer after a car accident?

Contact a lawyer immediately after a car accident. The sooner you contact a lawyer, the better chance you have of getting compensation for your damages. A lawyer can help you file a police report, collect evidence, negotiate a settlement with the other driver’s insurance company and fight your case in litigation.

Can I change my car accident lawyer?

Yes, you can change your car accident lawyer anytime during your case. It is important to make sure you have an attorney you can trust through the process. It is not advised to change attorneys often however, because a certain continuity of care should be present.

I do not think I have a claim?

A couple of times, clients have come to my office asking about one legal matter when  in reality they had a fully valid Car Accident injury claim. One of my clients was awarded a full insurance policy limits settlement after he thought he had another claim. After a brief fact finding investigation with the insruance company's attorneys and the case was settled for the full insurance policy limits.
